Court to decide case on Dana motors

The Isolo Magistrate Court, Isolo Lagos has commenced trial on a suit between Engr. (Dr) Victor Oyenuga, a Past President of the Nigerian Institution of Structural Engineers and Dana Motors Limited over a faulty Sorento car bought by the former which had become the bone of contention.
Oyenuga, the claimant who is also the Managing Director of Vasons Concept Consultants Limited in a statement of claims said he bought a brand new Kia Sorento car from the defendant sometime in 2009 but avers that the said car had been developing fault barely less than four months from its purchase and the said car has since then been undergoing series of repairs by the defendant.
Specifically, the claimant said the car between 28th January 2010 and 2nd September 2014 undergo repairs on 10 occasion while the claimant’s hope finally hit the rock sometime in October 2014 when the defendant informed that the said car engine had packed up.
The claimant stated further that the defendant is demanding over N1,7 million for further repairs of the damaged car when the original factory-assembled car did not last up to 71,000 kilometres- against world standard of 200,000 kilometre- on the road and packed up without warning barely less than 400km after the last service by the defendant.
The claimant claims that the said car is a bad product abinito emanating from the production line that was sold by the defendant to the claimant.
The claimant seeks an order of the Court directing/or compelling the defendant to replace the said Kia Sorento car with a brand new one for the claimant.
“A declaration of this honourable Court that the defendant has breached the contract between the claimant and the defendant by selling out a bad product Kia Sorento car the defendant should be compelled to replace and/or effect proper repairs on the said car at its own cost with warranty thereafter.
“The sum of N5 million only being the general damages against the defendant for the pain and suffering caused on the claimant over the usage of the car,”.
Meanwhile Magistrate Mrs Shonubi of Isolo Court (2) has adjourned the case to 28th April for further hearing based on addimissibility of original document from Dana Motors.
